Why Mediate

Dear Fellow Attorney:

Abraham Lincoln counseled the bar on the subject of dispute resolution over 150 years ago.

"Discourage litigation.  Persuade your neighbors to compromise.  Point out to them how the nominal winner is often a real loser in fees, expenses and waste of time.  As a peace maker, the lawyer has a superior opportunity to be a good person.  There will be business enough."

William Camden, British author, perhaps said it best:  "Agree, for the law is costly."

It makes sense to mediate cases!

1.)  Mediation is private, confidential and cost effective.

2.)  Mediation opens lines of communication.  Parties are able to be heard and to vent.

3.)  Parties can structure a resolution that the may not achieve in court.

4.)  Parties and their counsel receive a neutral evalutaion of their case.  Each side learns something.

5.)  75 to 90% of all cases that are mediated settle the day of the mediaton or shortly thereafter.

6.)  Clients are relieved of the burden of the dispute and can go on with their lives.

7.)  You have provided a service to the community.  "Blessed are the peacemakers!"
